Breaking the employment contract of an employee local representative, candidate for this position or former local representative in disregard of the provisions relating to the administrative authorisation procedure provided for in this book, is punishable by one year’s imprisonment and a fine of 3,750 euros.
Transferring the employment contract of a local representative who is part of a partial transfer of an undertaking or establishment, in disregard of the provisions relating to the administrative authorisation procedure, is punishable by the same penalties.
