Article L2436-1 of the French Labour Code

Dismissal of an employee representative on the board of directors or supervisory board of a public-sector undertaking, a public limited company or a partnership limited by shares, in disregard of the provisions relating to the administrative authorisation procedure set out in this book, is punishable by one year’s imprisonment and a fine of 3,750 euros. A repeat offence is punishable by two years’ imprisonment and a fine of 6,000 euros.

Le fait de licencier un représentant des salariés au conseil d’administration ou de surveillance d’une entreprise du secteur public, d’une société anonyme ou d’une société en commandite par actions, en méconnaissance des dispositions relatives à la procédure d’autorisation administrative prévues par le présent livre, est puni d’un emprisonnement d’un an et d’une amende de 3 750 euros. La récidive est punie d’un emprisonnement de deux ans et d’une amende de 6 000 euros.
