Article L251-5 of the French Commercial code

The nullity of the economic interest group and of its acts or deliberations may only result from a breach of the mandatory provisions of this chapter, or from one of the causes of nullity of contracts in general.

An action for nullity is extinguished when the cause of nullity has ceased to exist on the day on which the court rules on the merits at first instance, unless the nullity is based on the unlawfulness of the object of the grouping.

The articles 1844-12 to 1844-17 of the Civil Code are applicable to economic interest groupings.

La nullité du groupement d’intérêt économique ainsi que des actes ou délibérations de celui-ci ne peut résulter que de la violation des dispositions impératives du présent chapitre, ou de l’une des causes de nullité des contrats en général.

L’action en nullité est éteinte lorsque la cause de la nullité a cessé d’exister le jour où le tribunal statue sur le fond en première instance, sauf si cette nullité est fondée sur l’illicéité de l’objet du groupement.

Les articles 1844-12 à 1844-17 du code civil sont applicables aux groupements d’intérêt économique.
