Article L2523-6 of the French Labour Code

Once the parties have received the mediator’s proposal to settle the dispute, they may notify the mediator within a period of eight days, in accordance with the conditions laid down by regulation, that they reject the proposal. They shall state the reasons for their rejection. The mediator shall immediately inform the other organisation(s) involved in the dispute of these rejections and the reasons for them.

At the end of the eight-day period provided for in the first paragraph, the mediator shall record the agreement or disagreement.

The agreement of the parties to the mediator’s recommendation is binding on those who have not rejected it, under the conditions laid down in Book II relating to collective labour agreements. It is applicable under the conditions set out in article L. 2524-5.

A compter de la réception de la proposition de règlement du conflit soumise par le médiateur aux parties, celles-ci peuvent, pendant un délai de huit jours, notifier au médiateur, dans des conditions prévue par voie réglementaire, qu’elles rejettent sa proposition. Elles motivent leur rejet. Le médiateur informe aussitôt la ou les autres organisations parties au conflit de ces rejets et de leurs motivations.

Au terme du délai de huit jours prévu au premier alinéa, le médiateur constate l’accord ou le désaccord.

L’accord des parties sur la recommandation du médiateur lie celles qui ne l’ont pas rejetée, dans les conditions déterminées par le livre II relatif aux conventions et aux accords collectifs de travail. Il est applicable dans les conditions prévues par l’article L. 2524-5.
