Article L2523-7 of the French Labour Code

If the mediation attempt fails and after the expiry of a period of forty-eight hours from the date on which the disagreement was established, the mediator shall send the Minister responsible for labour the text of the reasoned and signed recommendation, together with a report on the dispute, as well as the reasoned rejections sent by the parties to the mediator.

The conclusions of the mediator’s recommendation and the parties’ rejections, together with their reasons, are made public within three months by the Minister for Employment.

En cas d’échec de la tentative de médiation et après l’expiration d’un délai de quarante-huit heures à compter de la constatation du désaccord, le médiateur communique au ministre chargé du travail le texte de la recommandation motivée et signée, accompagné d’un rapport sur le différend, ainsi que les rejets motivés adressés par les parties au médiateur.

Les conclusions de la recommandation du médiateur et les rejets des parties ainsi que leurs motivations sont rendus publics, dans un délai de trois mois, par le ministre chargé du travail.
