Article L2544-13 of the French General Code of Local Authorities

Where, according to a former custom, communal property is granted in separate and distinct lots and the number of entitled parties is greater than that of the lots, the admission of a new beneficiary can only take place when a lot has become vacant.

If several entitled parties present themselves in the event of a vacancy, the custom decides which of them is admitted to the enjoyment of the vacant lot.

In the absence of a custom, fate decides.

Lorsque, d’après un ancien usage, les biens communaux sont concédés par lots séparés et distincts et que le nombre des ayants droit est plus considérable que celui des lots, l’admission d’un nouveau bénéficiaire ne peut avoir lieu que lorsqu’un lot est devenu vacant.

Si plusieurs ayants droit se présentent en cas de vacance, l’usage décide lequel d’entre eux est admis à la jouissance du lot vacant.

A défaut d’usage, le sort décide.
