Article L2573-28 of the French General Code of Local Authorities

I. – The provisions of Chapter IV of Title II of Book II of Part Two mentioned in the left-hand column of the table below shall apply in French Polynesia, in the wording indicated in the right-hand column of the same table, subject to the adaptations provided for in II to V.

II. – For the application of Article L. 2224-7-1:

1° The words “in accordance with 6° of I of Article 43 of Organic Law No. 2004-192 of 27 February 2004 on the autonomous status of French Polynesia” are added to the first sentence;

2° The last sentence is deleted.

III. – For the application of Article L. 2224-8 :

1° In I, after the words: “of wastewater”, the words: “in accordance with 9° of I of Article 43 of Organic Law No. 2004-192 of 27 February 2004 on the autonomous status of French Polynesia” are inserted;

2° In II, the words: “referred to in Article L. 1331-4 du code de la santé publique” are replaced by the words: “necessary to bring wastewater to the public part of the connection”;

3° In III, the date of 31 December 2012 is replaced by the date of 31 December 2020.

IV. – For the application of the first paragraph of Article L. 2224-12, the words: “, after obtaining the opinion of the consultative commission for local public services,” are deleted.

IV bis. – For the application of the first paragraph of Article L. 2224-12-1-1:

1° In the first paragraph, the words: “, as provided for by Article L. 210-1 of the Environmental Code” are deleted;

2° In the second paragraph, the words: “, including expenditure relating to the allocation of a grant to the housing solidarity fund provided for in Article L. 2224-12-3-1. A payment may be made in this respect to communal or inter-communal social action centres.” are deleted;

3° The last paragraph is deleted.

V. – For the application of the first paragraph of Article L. 2224-12-2, the words: “and to the sums provided for by Articles L. 1331-1 to L. 1331-10 of the Public Health Code” are deleted.

I. – Les dispositions du chapitre IV du titre II du livre II de la deuxième partie mentionnées dans la colonne de gauche du tableau ci-après sont applicables en Polynésie française, dans leur rédaction indiquée dans la colonne de droite du même tableau, sous réserve des adaptations prévues du II au V.

II. – Pour l’application de l’article L. 2224-7-1 :

1° La première phrase est complétée par les mots : ” conformément au 6° du I de l’article 43 de la loi organique n° 2004-192 du 27 février 2004 portant statut d’autonomie de la Polynésie française ” ;

2° La dernière phrase est supprimée.

III. – Pour l’application de l’article L. 2224-8 :

1° Au I, après les mots : ” des eaux usées ” sont insérés les mots : ” conformément au 9° du I de l’article 43 de la loi organique n° 2004-192 du 27 février 2004 portant statut d’autonomie de la Polynésie française ” ;

2° Au II, les mots : ” visés à l’article L. 1331-4 du code de la santé publique ” sont remplacés par les mots : ” nécessaires pour amener les eaux usées à la partie publique du branchement ” ;

3° Au III, la date du 31 décembre 2012 est remplacée par la date du 31 décembre 2020.

IV. – Pour l’application du premier alinéa de l’article L. 2224-12, les mots : “, après avis de la commission consultative des services publics locaux, ” sont supprimés.

IV bis. – Pour l’application du premier alinéa de l’article L. 2224-12-1-1 :

1° Au premier alinéa, les mots : “, tel que prévu par l’article L. 210-1 du code de l’environnement” sont supprimés ;

2° Au deuxième alinéa, les mots : “, y compris les dépenses liées à l’attribution d’une subvention au fonds de solidarité pour le logement prévue à l’article L. 2224-12-3-1. Un versement peut être réalisé à ce titre aux centres communaux ou intercommunaux d’action sociale.” sont supprimés ;

3° Le dernier alinéa est supprimé.

V. – Pour l’application du premier alinéa de l’article L. 2224-12-2, les mots : ” et aux sommes prévues par les articles L. 1331-1 à L. 1331-10 du code de la santé publique ” sont supprimés.
