Article L313-43 of the French Monetary and Financial Code

The lending institution must make available to the holder of the promissory note, at the latter’s request, the contracts constituting these claims with their guarantees, any amendments to these contracts that may have been made to provide the lender with additional guarantees and the bills signed by the borrower to ensure compliance with his obligations, if such bills exist, in a principal amount equal to the principal amount of the promissory note.

The lending institution assumes custody of the contracts and instruments made available to the bearer of the promissory note and makes them available by keeping, in a file in the bearer’s name, a list of the names of each of the claims corresponding to the above contracts and instruments, as referred to in articles L. 313-42 to L. 313-49, with an up-to-date indication of their amount.

Les contrats constituant ces créances avec leurs garanties, les avenants à ces contrats qui ont pu être passés pour fournir au prêteur des garanties supplémentaires et les effets signés par l’emprunteur pour assurer le respect de ses obligations, s’il existe de tels effets, doivent être mis par l’établissement prêteur à la disposition du porteur du billet à ordre, si celui-ci en fait la demande, pour un montant en capital égal au montant en capital du billet à ordre.

L’établissement prêteur assume la garde des contrats et effets mis à la disposition du porteur du billet à ordre et réalise cette mise à disposition en conservant, sous un dossier au nom de ce dernier, une liste nominative, visant les articles L. 313-42 à L. 313-49, de chacune des créances correspondant aux contrats et effets ci-dessus, avec indication, tenue à jour, de leur montant.
