Article L313-46 of the French Monetary and Financial Code

If the holder of the promissory note fails to pay either the amount of the promissory note or the amount of the interest attached to the promissory note on the due date, and independently of any recourse he may have against the lending institution, the holder of the promissory note shall obtain, at his request and against return of the promissory note, delivery of the list of names provided for in article L. 313-43 and, where applicable, of the instruments made available to him pursuant to this paragraph. This delivery transfers to him, without further formality, ownership of the claims with the interest, benefits and guarantees attached thereto within the limit of the rights he has under the promissory note he has held.

Article L313-46

A défaut de paiement à l’échéance soit du montant du billet à ordre, soit du montant des intérêts attachés à ce billet, et indépendamment des recours qu’il peut exercer contre l’organisme prêteur, le porteur du billet à ordre obtient, sur sa demande et contre restitution de ce billet, la remise de la liste nominative prévue à l’article L. 313-43 et, le cas échéant, des effets mis à sa disposition en exécution du présent paragraphe. Cette remise lui transfère, sans autre formalité, la propriété des créances avec les intérêts, les avantages et les garanties qui y sont attachés dans la limite des droits qu’il tient du billet à ordre qu’il a détenu.
