Article L321-23-1 of the French Commercial code

A magistrate from the judiciary is appointed to perform the duties of Government Commissioner to the Conseil des maisons de vente.

The Government commissioner is assisted by a person who has not been involved in voluntary sales by public auction for less than five years.

The Government Commissioner investigates claims made against the persons mentioned in articles L. 321-4 and L. 321-24.

It may propose an amicable solution to disputes brought to its attention.

It shall initiate proceedings before the Enforcement Committee.

Un magistrat de l’ordre judiciaire est désigné pour exercer les fonctions de commissaire du Gouvernement auprès du Conseil des maisons de vente.


Le commissaire du Gouvernement est assisté d’une personnalité ayant cessé d’exercer depuis moins de cinq ans l’activité de vente volontaire aux enchères publiques.


Le commissaire du Gouvernement instruit les réclamations faites contre les personnes mentionnées aux articles L. 321-4 et L. 321-24.


Il peut proposer une solution amiable aux différends qui sont portés à sa connaissance.


Il engage les poursuites devant la commission des sanctions.
