Article L3211-2-2 of the French Public Health Code

When a person is admitted for psychiatric care pursuant to Chapters II or III of this Title, he/she is subject to a period of observation and initial care in the form of full hospitalisation.

Within twenty-four hours of admission, a doctor will carry out a full somatic examination of the person and a psychiatrist from the host establishment will draw up a medical certificate stating the person’s mental state and confirming whether or not it is necessary to continue psychiatric care with regard to the conditions for admission defined in articles L. 3212-1 or L. 3213-1. This psychiatrist may not be the author of the medical certificate or one of the two medical certificates on the basis of which the admission decision was made.

Within seventy-two hours of admission, a new medical certificate is drawn up under the same conditions as those set out in the second paragraph of this article.

When the two medical certificates have concluded that psychiatric care must be maintained, the psychiatrist proposes in the certificate referred to in the third paragraph of this article the form of care referred to in 1° and 2° of I of article L. 3211-2-1 and, where appropriate, the care programme. The reasons for this proposal must be given with regard to the patient’s state of health and the expression of his mental disorders.

Article L3211-2-2

Lorsqu’une personne est admise en soins psychiatriques en application des chapitres II ou III du présent titre, elle fait l’objet d’une période d’observation et de soins initiale sous la forme d’une hospitalisation complète.

Dans les vingt-quatre heures suivant l’admission, un médecin réalise un examen somatique complet de la personne et un psychiatre de l’établissement d’accueil établit un certificat médical constatant son état mental et confirmant ou non la nécessité de maintenir les soins psychiatriques au regard des conditions d’admission définies aux articles L. 3212-1 ou L. 3213-1. Ce psychiatre ne peut être l’auteur du certificat médical ou d’un des deux certificats médicaux sur la base desquels la décision d’admission a été prononcée.

Dans les soixante-douze heures suivant l’admission, un nouveau certificat médical est établi dans les mêmes conditions que celles prévues au deuxième alinéa du présent article.

Lorsque les deux certificats médicaux ont conclu à la nécessité de maintenir les soins psychiatriques, le psychiatre propose dans le certificat mentionné au troisième alinéa du présent article la forme de la prise en charge mentionnée aux 1° et 2° du I de l’article L. 3211-2-1 et, le cas échéant, le programme de soins. Cette proposition est motivée au regard de l’état de santé du patient et de l’expression de ses troubles mentaux.
