Article L3213-2 of the French General Code of Local Authorities

Any transfer of immovable property or rights in rem in immovable property by a department gives rise to a reasoned deliberation by the departmental council on the conditions of the sale and its essential characteristics. The departmental council deliberates in the light of the opinion of the competent State authority. This opinion is deemed to have been given at the end of a period of one month from the date of referral to this authority.

The balance sheet of acquisitions and disposals carried out on the territory of a department by that department or by a public or private person acting under an agreement with that department gives rise each year to a deliberation by the departmental council. This balance sheet is appended to the department’s administrative account.

Toute cession d’immeubles ou de droits réels immobiliers par un département donne lieu à délibération motivée du conseil départemental portant sur les conditions de la vente et ses caractéristiques essentielles. Le conseil départemental délibère au vu de l’avis de l’autorité compétente de l’Etat. Cet avis est réputé donné à l’issue d’un délai d’un mois à compter de la saisine de cette autorité.

Le bilan des acquisitions et cessions opérées sur le territoire d’un département par celui-ci ou par une personne publique ou privée agissant dans le cadre d’une convention avec ce département donne lieu chaque année à une délibération du conseil départemental . Ce bilan est annexé au compte administratif du département.
