Article L3214-2 of the French General Code of Local Authorities

The departmental council, unless it has delegated its competence to the president, pursuant to article L. 3211-2, awards and withdraws grants maintained from departmental funds, on the reasoned advice of:

1° The head of the establishment and the board of directors, for public educational establishments;

2° The head of the establishment, for private educational establishments.

The competent authority may pronounce withdrawal in cases of urgency; it shall immediately give notice thereof to the president of the departmental council and make known the reasons.

Article L3214-2

Le conseil départemental, sauf s’il a délégué sa compétence au président, en application de l’article L. 3211-2, attribue et retire les bourses entretenues sur les fonds départementaux, sur l’avis motivé :

1° Du chef d’établissement et du conseil d’administration, pour les établissements publics d’enseignement ;

2° Du responsable d’établissement, pour les établissements d’enseignement privé.

L’autorité compétente peut prononcer le retrait dans les cas d’urgence ; elle en donne avis immédiatement au président du conseil départemental et en fait connaître les motifs.
