Article L322-2 of the French Commercial code

Sales of goods after judicial liquidation are made in accordance with Articles L. 642-19 et seq.

They may be conducted by the ministry of judicial auctioneers, notaries or bailiffs when they take place at retail or by lots, or by the ministry of sworn merchandise brokers when they take place at wholesale. The debtor’s movable property other than goods may only be sold at auction by the ministry of judicial auctioneers, notaries or bailiffs, in application of the laws and regulations governing the interventions of these various officers.

Les ventes de marchandises après liquidation judiciaire sont faites conformément aux articles L. 642-19 et suivants.

Elles peuvent être faites par le ministère des commissaires-priseurs judiciaires, des notaires ou des huissiers de justice lorsqu’elles ont lieu au détail ou par lots, ou par le ministère des courtiers de marchandises assermentés lorsqu’elles ont lieu en gros. Les biens meubles du débiteur autres que les marchandises ne peuvent être vendus aux enchères que par le ministère des commissaires-priseurs judiciaires, des notaires ou des huissiers de justice, en application des lois et règlements régissant les interventions de ces différents officiers.
