Article L3221-4-1 of the French General Code of Local Authorities

The president of the departmental council or, where he is the authority holding traffic police powers, the mayor or the president of the public establishment for inter-communal cooperation may set, for sections of roads outside built-up areas under his jurisdiction and not comprising at least two lanes assigned to the same direction of traffic, a maximum authorised speed 10 km/h higher than that provided for in the highway code. This decision takes the form of a reasoned order, issued after consultation with the departmental road safety committee, on the basis of an accident study covering each of the road sections concerned.

Le président du conseil départemental ou, lorsqu’il est l’autorité détentrice du pouvoir de police de la circulation, le maire ou le président de l’établissement public de coopération intercommunale peut fixer, pour les sections de routes hors agglomération relevant de sa compétence et ne comportant pas au moins deux voies affectées à un même sens de circulation, une vitesse maximale autorisée supérieure de 10 km/ h à celle prévue par le code de la route. Cette décision prend la forme d’un arrêté motivé, pris après avis de la commission départementale de la sécurité routière, sur la base d’une étude d’accidentalité portant sur chacune des sections de route concernées.
