Where, in a public limited company, a département is a member or chairman of the board of directors, a member of the management board or a member or chairman of the supervisory board, the civil liability arising from the exercise of the mandate of the département’s representatives is incumbent on the département and not on those representatives.

Lorsque, dans une société anonyme, un département a la qualité de membre ou de président du conseil d’administration, de membre du directoire, de membre ou de président du conseil de surveillance, la responsabilité civile résultant de l’exercice du mandat des représentants du département incombe au département et non à ces représentants.
