Article L3232-1-2 of the French General Code of Local Authorities

As an exception to article L. 1511-2, the département may, by agreement with the region and in addition to the latter, participate, by means of subsidies, in the financing of aid granted by the region in favour of departmental, interdepartmental or regional committees for sea fishing and marine farming within the meaning of articles L. 912-1 et seq. of the rural and maritime fishing code, regional shellfish farming committees within the meaning of articles L. 912-6 et seq. of the same code, producer organisations within the meaning of articles L. 551-1 et seq. of the said code and companies engaged in the production, marketing and processing of agricultural products, forestry products or fisheries and aquaculture products.

This aid forms part of a rural and regional development programme or an operational programme for the implementation of European funds linked to fisheries and maritime affairs or an existing aid scheme within the meaning of European law, notified or exempted from notification.

The aid is to be granted in the form of a grant or a subsidy.

Par dérogation à l’article L. 1511-2, le département peut, par convention avec la région et en complément de celle-ci, participer, par des subventions, au financement d’aides accordées par la région en faveur de comités départementaux, interdépartementaux ou régionaux des pêches maritimes et des élevages marins au sens des articles L. 912-1 et suivants du code rural et de la pêche maritime, de comités régionaux de la conchyliculture au sens des articles L. 912-6 et suivants du même code, d’organisations de producteurs au sens des articles L. 551-1 et suivants dudit code et d’entreprises exerçant une activité de production, de commercialisation et de transformation de produits agricoles, de produits de la forêt ou de produits de la pêche et de l’aquaculture.

Ces aides s’inscrivent dans un programme de développement rural et régional ou dans le cadre d’un programme opérationnel de mise en œuvre des fonds européens liés à la pêche et aux affaires maritimes ou dans un régime d’aides existant au sens du droit européen, notifié ou exempté de notification.
