The Saint-Martin Territorial Commission for Psychiatric Hospitalisation is made up of :
1° A psychiatrist or, failing that, a doctor with knowledge and experience in psychiatry appointed by the public prosecutor at the Basse-Terre Court of Appeal;
2° (Repealed) ;
3° Two representatives of approved associations of patients and families of persons suffering from mental disorders, or, failing this, two qualified persons, appointed by the State representative;
4° A general practitioner appointed by the State representative.
The members of the commission may not be members of a governing body of a health establishment receiving patients with mental disorders pursuant to Chapters II and III of Title I of this Book.
They may not, outside the scope of the Commission’s remit, disclose any information they may have obtained about the persons whose situation has been presented to them. Subject to the provisions of 4° and 6° of article L. 3223-1, they are bound by professional secrecy under the conditions laid down in articles 226-13 and 226-14 of the French Criminal Code.
The commission appoints its chairman from among its members under conditions laid down by order of the ministers responsible for overseas France and health.
