Article L3251-1 of the French Public Health Code

I.-When a request for a person to be admitted for psychiatric care has been submitted under the conditions provided for in 1° of II of article L. 3212-1 or when an imminent danger to the person’s health has been established under the conditions provided for in 2° of the same II, the State representative will, with a view to admitting the person into psychiatric care, issue an order for the person’s transfer to a facility located in Saint-Martin, Guadeloupe or Martinique and authorised to treat people suffering from mental disorders in accordance with locally applicable regulations.

II – Similarly, the State representative will issue a health transfer order for a person whose mental disorder requires treatment and compromises his or her safety or that of other people, or seriously undermines public order.

III – The reasons for the transfer order are given in the detailed medical certificate(s) stating that the person concerned has a mental disorder requiring care with constant or regular supervision in an establishment authorised to treat people with mental disorders. In addition, where appropriate, reasons are given in the light of the report drawn up by the police authorities establishing the risk of harm to personal safety and public order.

I.-Lorsqu’une demande d’admission d’une personne en soins psychiatriques a été présentée dans les conditions prévues au 1° du II de l’article L. 3212-1 ou lorsqu’un péril imminent pour la santé de la personne a été constaté dans les conditions prévues au 2° du même II, le représentant de l’Etat prend, en vue de l’admission en soins psychiatriques de la personne, un arrêté de transfert sanitaire de celle-ci à destination d’un établissement situé à Saint-Martin, en Guadeloupe ou en Martinique et habilité à soigner les personnes atteintes de troubles mentaux conformément à la réglementation localement applicable.

II.-De même, le représentant de l’Etat prend un arrêté de transfert sanitaire à l’égard d’une personne dont les troubles mentaux nécessitent des soins et compromettent sa sûreté ou celle des autres personnes ou portent atteinte, de façon grave, à l’ordre public.

III.-L’arrêté de transfert est motivé au regard du ou des certificats médicaux circonstanciés constatant l’existence chez l’intéressé de troubles mentaux nécessitant des soins assortis d’une surveillance constante ou régulière dans un établissement habilité à soigner les personnes atteintes de troubles mentaux. En outre, il est, le cas échéant, motivé au regard du procès-verbal dressé par les autorités de police établissant le risque d’atteinte à la sûreté des personnes et à l’ordre public.
