Article L3251-5 of the French Public Health Code

I.-In the event that the health transfer order has been issued on the basis of I of article L. 3251-1, the State representative in the host community will transfer the person concerned, upon arrival, to an establishment authorised to treat people suffering from mental disorders and the psychiatric care admission procedure provided for in article L. 3212-1 will be implemented, in accordance with the regulations applicable locally.

II – In the event that the health transfer order has been issued on the basis of II of article L. 3251-1, the State representative in the host community assesses whether it is appropriate to implement the psychiatric care admission procedure provided for in article L. 3213-1 in accordance with locally applicable regulations.

I.-Dans le cas où l’arrêté de transfert sanitaire a été pris sur le fondement du I de l’article L. 3251-1, le représentant de l’Etat dans la collectivité d’accueil achemine l’intéressé, dès son arrivée, vers un établissement habilité à soigner les personnes atteintes de troubles mentaux et la procédure d’admission en soins psychiatriques prévue à l’article L. 3212-1 est mise en œuvre, selon la réglementation applicable localement.

II.-Dans le cas où l’arrêté de transfert sanitaire a été pris sur le fondement du II de l’article L. 3251-1, le représentant de l’Etat dans la collectivité d’accueil apprécie s’il y a lieu de mettre en œuvre la procédure d’admission en soins psychiatriques prévue à l’article L. 3213-1 selon la réglementation applicable localement.
