Civil actions and claims relating to literary and artistic property, including when they also relate to a related issue of unfair competition, shall be brought exclusively before judicial courts, determined by regulation.
Regularly constituted professional defence bodies shall be entitled to institute legal proceedings to defend the interests for which they are statutorily responsible.
A beneficiary validly invested on an exclusive basis, in accordance with the provisions of Book II, with an exclusive right of exploitation belonging to a phonogram or videogram producer may, unless otherwise stipulated in the licensing contract, bring legal action in respect of that right. The producer is notified of the exercise of the action.
The foregoing provisions do not preclude recourse to arbitration, under the conditions set out in articles 2059 and 2060 of the Civil Code.
