Any unsolicited contact, by any means whatsoever, with a specific natural person or legal entity with a view to obtaining their agreement to … constitutes a banking or financial solicitation:
1° The execution by one of the persons mentioned in 1° of Article L. 341-3 of a transaction in one of the financial instruments listed in Article L. 211-1 ;
2° The performance by one of the persons referred to in 1° or 4° of article L. 341-3 of a banking or related transaction as defined in articles L. 311-1 and L. 311-2;
3° The provision by one of the persons referred to in 1° of Article L. 341-3 of an investment service or a related service as defined in Articles L. 321-1 and L. 321-2;
4° Carrying out a transaction in miscellaneous goods as referred to in article L. 551-1 ;
5° The provision by one of the persons referred to in 3° of article L. 341-3 of investment advice as defined in I of article L. 541-1;
6° The provision by one of the persons mentioned in 1° of Article L. 341-3 of a payment service provided for in II of Article L. 314-1;
7° The provision of a participative financing service by a provider of participative financing services mentioned in Article L. 547-1 and by any provider of participative financing services approved in another Member State of the European Union and authorised to operate on French territory;
8° Carrying out a transaction involving one of the digital assets referred to in Article L. 54-10-1, in particular as part of a public offering of tokens within the meaning of Article L. 552-3 ;
9° The provision of a service on digital assets within the meaning of Article L. 54-10-2.
Physical visits to people’s homes, workplaces or places not intended for the marketing of financial products, instruments and services, for the same purpose, are also considered to be banking or financial canvassing, regardless of the person initiating the approach.
The activity of canvassing for banking or financial services is carried out without prejudice to the application of special provisions relating to the provision of investment services, banking and payment services and transactions in various goods, as well as the provisions ofarticle 66-4 of law no. 71-1130 of 31 December 1971 reforming certain judicial and legal professions.
