Article L3441-4-1 of the French General Code of Local Authorities

In the areas of competence of the overseas department, the president of the departmental council may, for the duration of his term of office, draw up a regional cooperation framework programme specifying the nature, object and scope of the international commitments that he proposes to negotiate, in compliance with the international commitments of the Republic, with one or more States, territories or regional bodies mentioned in Article L. 3441-2.

The president of the departmental council submits this framework programme to the deliberation of the departmental council, which may then request, in the same deliberation, that the authorities of the Republic authorise its president to negotiate the agreements provided for in this framework programme.

Where such authorisation is expressly granted, the president of the departmental council may enter into the negotiations provided for in the framework programme. He shall inform the authorities of the Republic which, at their request, shall be represented at the negotiations.

The president of the departmental council submits any amendments to its framework programme for deliberation by the departmental council. These modifications are approved by the authorities of the Republic, under the same conditions as the initial procedure.

At the end of the negotiations, the draft agreement is submitted to the deliberation of the departmental council for acceptance. The authorities of the Republic may then, subject to compliance with its international commitments, give power to the President of the Departmental Council for the purpose of signing the agreement.

Article L3441-4-1

Dans les domaines de compétence du département d’outre-mer, le président du conseil départemental peut, pour la durée de l’exercice de ses fonctions, élaborer un programme-cadre de coopération régionale précisant la nature, l’objet et la portée des engagements internationaux qu’il se propose de négocier, dans le respect des engagements internationaux de la République, avec un ou plusieurs Etats, territoires ou organismes régionaux mentionnés à l’article L. 3441-2.

Le président du conseil départemental soumet ce programme-cadre à la délibération du conseil départemental, qui peut alors demander, dans la même délibération, aux autorités de la République d’autoriser son président à négocier les accords prévus dans ce programme-cadre.

Lorsque cette autorisation est expressément accordée, le président du conseil départemental peut engager les négociations prévues dans le programme-cadre. Il en informe les autorités de la République qui, à leur demande, sont représentées à la négociation.

Le président du conseil départemental soumet toute modification de son programme-cadre à la délibération du conseil départemental. Ces modifications sont approuvées par les autorités de la République, dans les mêmes conditions que la procédure initiale.

A l’issue de la négociation, le projet d’accord est soumis à la délibération du conseil départemental pour acceptation. Les autorités de la République peuvent ensuite donner, sous réserve du respect des engagements internationaux de celle-ci, pouvoir au président du conseil départemental aux fins de signature de l’accord.
