Article L3444-1 of the French General Code of Local Authorities

The departmental councils of the overseas departments are consulted on draft laws, ordinances or decrees containing provisions for adapting the legislative regime and administrative organisation of these departments.

The opinion of the departmental councils is deemed to have been obtained in the absence of notification to the State representative of an express opinion within one month of the referral. This period is reduced to fifteen days in the event of an emergency at the request of the State representative.

Les conseils départementaux des départements d’outre-mer sont consultés sur les projets de loi, d’ordonnance ou de décret comportant des dispositions d’adaptation du régime législatif et de l’organisation administrative de ces départements.

L’avis des conseils départementaux est réputé acquis en l’absence de notification au représentant de l’Etat d’un avis exprès dans un délai d’un mois à compter de la saisine. Ce délai est réduit à quinze jours en cas d’urgence sur demande du représentant de l’Etat.
