Article L3444-2 of the French General Code of Local Authorities

The departmental councils of the overseas departments may submit proposals to amend the legislative or regulatory provisions in force, as well as any legislative or regulatory proposals concerning the economic, social and cultural development of these departments. These proposals may relate to the differentiation, referred to in Article L. 1111-3-1, of the rules relating to the allocation and exercise of powers applicable to these departments, in order to take account of differences in situations.

The proposals adopted by the departmental councils in application of the first paragraph of this article are forwarded by the departmental council presidents to the Prime Minister, to the State representative in the departments concerned and, when they relate to legislative provisions, to the presidents of the National Assembly and the Senate.

The Prime Minister acknowledges receipt of the proposals forwarded to him. An annual report will indicate the action taken on these proposals. This report is made public.

They may also make any comments or suggestions to the Prime Minister concerning the operation of the State’s public services in the department.

Les conseils départementaux des départements d’outre-mer peuvent présenter des propositions de modification des dispositions législatives ou réglementaires en vigueur, ainsi que toutes propositions législatives ou réglementaires concernant le développement économique, social et culturel de ces départements. Ces propositions peuvent porter sur la différenciation, mentionnée à l’article L. 1111-3-1, des règles relatives à l’attribution et à l’exercice des compétences applicables à ces départements, afin de tenir compte des différences de situations.

Les propositions adoptées par les conseils départementaux en application du premier alinéa du présent article sont transmises par les présidents de conseil départemental au Premier ministre, au représentant de l’Etat dans les départements concernés et, lorsqu’elles portent sur des dispositions législatives, aux présidents de l’Assemblée nationale et du Sénat.

Le Premier ministre accuse réception des propositions qui lui sont transmises. Un rapport annuel indique les suites qui ont été données à ces propositions. Ce rapport est rendu public.

Ils peuvent également faire au Premier ministre toutes remarques ou suggestions concernant le fonctionnement des services publics de l’Etat dans le département.
