Article L4061-3 of the French Public Health Code

I. – A healthcare professional is subject to the professional sanctions provided for in article L. 4137-1 of the Defence Code for acts committed as a result of or in the course of his professional practice:

1° As part of a commitment to serve in the operational reserve, as referred to in article L.4143-1 of the same code;

2° On standby, in accordance with the provisions of article L. 4139-9 of the same code;

3° When he is returned to the first section, in accordance with the provisions of article L. 4141-4 of the same code.

II. – He remains on the roll of his professional order. However, he shall not be subject to the disciplinary jurisdiction of this association or, where applicable, to the technical inspection courts for the acts mentioned in I.

Article L4061-3

I. – Un professionnel de santé est exposé aux sanctions professionnelles prévues à l’article L. 4137-1 du code de la défense pour les actes commis du fait ou à l’occasion de son exercice professionnel :

1° Au titre d’un engagement à servir dans la réserve opérationnelle, mentionné à l’article L.4143-1 du même code ;

2° Au titre de la disponibilité, conformément aux dispositions de l’article L. 4139-9 du même code ;

3° Lorsqu’il est replacé en première section, conformément aux dispositions de l’article L. 4141-4 du même code.

II. – Il demeure inscrit au tableau de son ordre professionnel. Toutefois, il n’est pas soumis à la juridiction disciplinaire de cet ordre ou s’il y a lieu du contentieux du contrôle technique pour les actes mentionnés au I.
