Article L412-1 of the French Intellectual Property Code

A public interest grouping comprising, in particular, the State and the Institut national de la recherche agronomique performs the functions of the national plant variety authority. In this capacity, it is responsible for:

1° Applying the laws and regulations on plant variety protection and, in particular, issuing the certificate referred to in Article L. 623-4;

2° To support the State in drawing up national regulations and international agreements relating to plant varieties.

The person responsible within the public interest grouping for the tasks falling within the remit of the national plant variety authority is appointed by the Minister responsible for agriculture. He shall take the decisions provided for in this code when issuing, rejecting or maintaining plant variety certificates. He performs his duties independently of any hierarchical or supervisory authority.

Article L412-1

Un groupement d’intérêt public comprenant notamment l’Etat et l’Institut national de la recherche agronomique assure les fonctions d’instance nationale des obtentions végétales. A ce titre, il est chargé :

1° D’appliquer les lois et règlements en matière de protection des obtentions végétales et, notamment, de délivrer le certificat mentionné à l’article L. 623-4 ;

2° D’apporter son appui à l’Etat pour l’élaboration de la réglementation nationale et des accords internationaux relatifs aux variétés végétales.

Le responsable au sein du groupement d’intérêt public des missions relevant de l’instance nationale des obtentions végétales est nommé par le ministre chargé de l’agriculture. Il prend les décisions prévues au présent code à l’occasion de la délivrance, du rejet ou du maintien des certificats d’obtention végétale. Il exerce ses fonctions indépendamment de toute autorité hiérarchique ou de tutelle.
