A conciliation commission consisting of at least three of its members is set up within each departmental council. Conciliation may be carried out by one or more of the members of this committee, in accordance with the procedures laid down by decree in the Conseil d’Etat.
When a complaint is lodged with the departmental council, its chairman will acknowledge receipt to the complainant, inform the doctor, dental surgeon or midwife who is the subject of the complaint and summon them within one month of the date of registration of the complaint with a view to conciliation. If this fails, he will forward the complaint to the Disciplinary Chamber of First Instance, with the Council’s reasoned opinion, within three months of the date on which the complaint was registered, involving himself where appropriate.
If the dispute involves one of its members, the president of the departmental council immediately asks the president of the National Council to appoint another council to conciliate the dispute.
If the departmental council fails to do so, the author of the complaint may ask the president of the national council to refer the matter to the competent disciplinary chamber of first instance. The President of the National Council forwards the complaint within one month.
