Insurance undertakings covering the civil liability risks referred to in Article L. 1142-2 in France shall transmit to the Autorité de contrôle prudentiel et de résolution instituted under Article L. 612-1 of the Monetary and Financial Code accounting, prudential or statistical data on these risks.
Where this obligation to transmit data is not complied with, the supervisory authority may impose sanctions in accordance with the conditions set out in Article L. 612-39 of the Monetary and Financial Code, with the exception of 3°, 4°, 5°, 6° and 7°.
The Autorité de contrôle prudentiel et de résolution analyses these data, transmits them in aggregated form and reports on them to the ministers responsible for the economy and social security. A copy of the report is sent to the Observatoire des risques médicaux.
An order of the ministers responsible for the economy and social security specifies the procedures for applying this article and, in particular, the applicable deadlines and the nature, frequency and content of the information that insurance undertakings are required to send to the Autorité de contrôle prudentiel et de résolution.
