Article L421-2 of the French Monetary and Financial Code

A regulated market is managed by a market undertaking. This undertaking takes the form of a commercial company. Where the market undertaking manages a regulated market, its registered office and effective management are established in mainland France or in the overseas departments or the Department of Mayotte or Saint-Martin. The market undertaking must at all times comply with the laws and regulations applicable to it.

The market undertaking carries out acts relating to the organisation and operation of each regulated market that it manages. It shall ensure that each regulated market it manages complies at all times with the requirements applicable to it.

Un marché réglementé est géré par une entreprise de marché. Celle-ci a la forme d’une société commerciale. Lorsque l’entreprise de marché gère un marché réglementé, son siège social et sa direction effective sont établis sur le territoire de la France métropolitaine ou des départements d’outre-mer ou du Département de Mayotte ou de Saint-Martin. L’entreprise de marché doit satisfaire à tout moment aux dispositions législatives et réglementaires qui lui sont applicables.

L’entreprise de marché effectue les actes afférents à l’organisation et l’exploitation de chaque marché réglementé qu’elle gère. Elle veille à ce que chaque marché réglementé qu’elle gère remplisse en permanence les exigences qui lui sont applicables.
