Article L421-27 of the French Code governing the entry and residence of foreign nationals and the right of asylum

A foreign national who has been admitted to reside in another Member State of the European Union for the same reasons as those mentioned in the first paragraph of article L. 421-26 may carry out an assignment in France for a period of ninety days or less, as part of the temporary secondment provided for in 2° of article L. 1262-1 of the Labour Code, in order to occupy a senior management position or to contribute his expertise in an establishment or company of the group employing him, under cover of a residence permit bearing the word “ICT” issued in the first Member State for the purposes of temporary intra-group secondment.
The establishment or company established in the first Member State must notify the competent administrative authorities of the first Member State and the competent administrative authority designated by order of the minister responsible for immigration of the foreign national’s planned mobility, as soon as it is known.
When this assignment is for a period of more than ninety days, the foreign national who provides proof of sufficient resources is authorised to work and reside in France under a multi-annual residence permit bearing the words “salarié détaché mobile ICT” for a period identical to that of the planned assignment, up to a maximum duration of three years less, where applicable, the duration of stays already completed in other Member States in connection with a similar assignment, without the condition provided for in Article L. 412-1.

Article L421-27

L’étranger ayant été admis au séjour dans un autre Etat membre de l’Union européenne pour les mêmes motifs que ceux mentionnés au premier alinéa de l’article L. 421-26 peut effectuer en France une mission d’une durée inférieure ou égale à quatre-vingt-dix jours, dans le cadre du détachement temporaire prévu au 2° de l’article L. 1262-1 du code du travail, afin d’occuper un poste d’encadrement supérieur ou d’apporter son expertise dans un établissement ou une entreprise du groupe qui l’emploie, sous couvert du titre de séjour portant la mention ” ICT ” délivré dans le premier Etat membre aux fins d’un détachement temporaire intragroupe.
L’établissement ou l’entreprise établi dans le premier Etat membre notifie au préalable le projet de mobilité de l’étranger, dès lors qu’il est connu, aux autorités administratives compétentes du premier Etat membre ainsi qu’à l’autorité administrative compétente désignée par arrêté du ministre chargé de l’immigration.
Lorsque cette mission est d’une durée supérieure à quatre-vingt-dix jours, l’étranger qui justifie de ressources suffisantes est autorisé à travailler et à séjourner en France au titre d’une carte de séjour pluriannuelle portant la mention ” salarié détaché mobile ICT ” d’une durée identique à celle de la mission envisagée, dans la limite d’une durée maximale de trois ans diminuée, le cas échéant, de la durée des séjours déjà effectués dans les autres Etats membres dans le cadre d’une mission similaire, sans que soit opposable la condition prévue à l’article L. 412-1.
