I.-The following are subject to the principle of extended producer responsibility pursuant to Article L. 541-10 of the Environmental Code , operators or importers of medicinal products, manufacturers or their agents, distributors or importers of devices mentioned respectively in Article 1 of Regulation (EU) 2017/745 of the European Parliament and of the Council of 5 April 2017 and in Article 1 of Regulation (EU) 2017/746 of the European Parliament and of the Council of 5 April 2017 who manufacture, import or introduce onto the national market equipment or materials, whether or not associated with a medicinal product or a device mentioned in Article 1 of the aforementioned Regulation (EU) 2017/745 or in Article 1 of the aforementioned Regulation (EU) 2017/746, the use of which leads directly to the production of waste from healthcare activities involving perforating infectious risks by self-treatment patients and users of the self-tests mentioned in Article L. 3121-2-2.
II – Pharmacy pharmacies are required to collect, free of charge, waste from healthcare activities involving the risk of perforating infectious substances produced by patients undergoing self-treatment and users of the self-diagnostic devices mentioned in article L. 3121-2-2, brought in by private individuals who own them.
Internal-use pharmacies and medical biology laboratories may collect, free of charge, the perforating waste from healthcare activities involving infectious risks mentioned in the first paragraph of this II.
III – A decree in the Council of State, issued after obtaining the opinion of the Competition Authority, specifies :
1° The conditions for the collection and treatment, within the meaning of Article L. 541-2 of the Environmental Code, of the waste mentioned in I of this article ;
2° The conditions for sharing the financing of this collection and treatment by the persons mentioned in I ;
3° The penalties for non-compliance with the obligations mentioned in II, within the limits of those laid down in article L. 541-10 of the Environment Code.
