Doctors established in a commune where there is no pharmacy may be authorised by the Director General of the Regional Health Agency, who will inform the State representative in the département, to keep a stock of medicines on their premises, and to dispense to the people for whom they provide care, the reimbursable and non-reimbursable medicines, as well as the medical devices necessary to continue the treatment they have prescribed, according to a list drawn up by the Minister of Health, after consulting the National Council of the Order of Doctors and the National Council of the Order of Pharmacists. This authorisation must only be granted when required in the interests of public health.

Any doctor replacing a doctor who has been granted authorisation to practise propharmacy is automatically granted this same authorisation for the duration of the replacement.

Any doctor setting up in the same practice as a doctor with authorisation to practise as a propharmacist is automatically granted the same authorisation to practise in that practice.

It specifies the localities in which home delivery of medicines is also authorised.

The authorisation is withdrawn as soon as a pharmacy is set up in one of the localities mentioned in the authorisation.

Doctors who have been granted authorisation to practise propharmacy are subject to all the legislative and regulatory obligations incumbent on pharmacists.

Under no circumstances may they have a pharmacy open to the public. They must only dispense medicines prescribed by them during their consultation.

Les médecins établis dans une commune dépourvue d’officine de pharmacie peuvent être autorisés par le directeur général de l’agence régionale de santé, qui en informe le représentant de l’Etat dans le département, à avoir chez eux un dépôt de médicaments, et à délivrer aux personnes auxquelles ils donnent leurs soins, les médicaments remboursables et non remboursables, ainsi que les dispositifs médicaux nécessaires à la poursuite du traitement qu’ils ont prescrit, selon une liste établie par le ministre chargé de la santé, après avis du Conseil national de l’ordre des médecins, et du Conseil national de l’ordre des pharmaciens. Cette autorisation ne doit être accordée que lorsque l’intérêt de la santé publique l’exige.

Tout médecin remplaçant un médecin bénéficiant d’une autorisation d’exercer la propharmacie se voit automatiquement accorder cette même autorisation pour la durée du remplacement.

Tout médecin s’établissant dans le même cabinet qu’un médecin bénéficiant d’une autorisation d’exercer la propharmacie se voit automatiquement accorder cette même autorisation pour l’exercice dans ce cabinet.

Elle mentionne les localités dans lesquelles la délivrance des médicaments au domicile du malade est également autorisée.

Elle est retirée dès qu’une officine de pharmacie est créée dans une des communes mentionnées dans l’autorisation.

Les médecins bénéficiant d’une autorisation d’exercer la propharmacie sont soumis à toutes les obligations législatives et réglementaires incombant aux pharmaciens.

Ils ne peuvent en aucun cas avoir une officine ouverte au public. Ils doivent ne délivrer que les médicaments prescrits par eux au cours de leur consultation.
