Article L4251-16 of the French General Code of Local Authorities

The regional plan and, where applicable, the strategic guidelines document mentioned in article L. 4251-15 are approved by order of the State representative in the region.

The latter shall ensure that the regional council and, where applicable, the metropolitan council, comply with the preparation procedure provided for in this chapter and that national interests are safeguarded.

If the representative of the State in the region does not approve the plan, he will notify the regional council by means of a reasoned decision, specifying the amendments to be made to the plan. The regional council has three months from the date of notification to take into account the requested modifications.

If it does not approve the strategic guidelines document, the representative of the State in the region notifies the metropolitan council by means of a reasoned decision, which specifies the amendments to be made to the document. The metropolitan council has a period of three months from the date of notification to take into account the requested amendments.

Le schéma régional et, le cas échéant, le document d’orientations stratégiques mentionné à l’article L. 4251-15 sont approuvés par arrêté du représentant de l’Etat dans la région.

Ce dernier s’assure du respect, par le conseil régional et, le cas échéant, par le conseil de la métropole, de la procédure d’élaboration prévue au présent chapitre et de la préservation des intérêts nationaux.

S’il n’approuve pas le schéma, le représentant de l’Etat dans la région le notifie au conseil régional par une décision motivée, qui précise les modifications à apporter au schéma. Le conseil régional dispose d’un délai de trois mois à compter de la notification pour prendre en compte les modifications demandées.

S’il n’approuve pas le document d’orientations stratégiques, le représentant de l’Etat dans la région le notifie au conseil de la métropole par une décision motivée, qui précise les modifications à apporter au document. Le conseil de la métropole dispose d’un délai de trois mois à compter de la notification pour prendre en compte les modifications demandées.
