A nurse is any person who usually provides nursing care on medical prescription or advice, or in accordance with his or her own role.
Nurses are involved in a variety of activities, including prevention, health education, training and supervision.
Nurses may, under conditions laid down by decree in the Conseil d’Etat :
1° Prescribe certain vaccines, the list of which and, where applicable, the persons who may benefit from them are determined by an order of the Minister for Health issued after consultation with the High Authority for Health and the National Agency for the Safety of Medicines and Health Products;
2° Administer certain vaccines, the list of which and, where applicable, the persons likely to benefit from them are determined by an order of the Minister for Health issued after consultation with the Haute Autorité de santé.
Nurses are authorised to renew prescriptions for oral contraceptives that are less than one year old, unless they are on a list established by order of the Minister for Health, on the recommendation of the Agence nationale de sécurité du médicament et des produits de santé, for a maximum period of six months, which may not be renewed. This provision also applies to nurses working in the establishments mentioned in the third paragraph of I of Article L. 5134-1 and in the services mentioned in the first paragraph of Article L. 2112-1 and in Article L. 2311-4 .
In a protocol as part of coordinated practice as provided for in articles L. 1411-11-1, L. 1434-12, L. 6323-1 and L. 6323-3, and under conditions laid down by decree, the nurse is authorised to adapt the dosage of certain treatments for a given pathology. The list of these diseases and treatments is set by decree of the Minister of Health, after obtaining the opinion of the French National Authority for Health. This adjustment can only be made on the basis of the results of medical biology analyses, unless otherwise indicated by the doctor, and subject to the patient’s designated treating doctor being informed.
An order by the ministers responsible for health and social security sets the list of medical devices that nurses, when acting on a doctor’s prescription, may prescribe to their patients unless otherwise indicated by the doctor and subject, for those medical devices for which the order specifies this, to the patient’s designated attending doctor being informed.
Nurses may prescribe nicotine substitutes, antiseptic solutions and products and physiological serum on an optional medical prescription basis.
Unless otherwise indicated by the doctor, nurses holding a State diploma in childcare may prescribe medical devices to support breastfeeding. A decree issued by the health and social security ministers sets out the list of medical devices concerned.
Nurses are authorised to take charge of the prevention and treatment of wounds and to prescribe additional examinations and health products. The conditions for this are defined by decree in the Conseil d’Etat and the list of prescriptions for complementary examinations and authorised health products is defined by an order, issued after consultation with the Haute Autorité de santé. The results of the nurse’s interventions are recorded in the medical file and the doctor is kept informed. This information is transmitted using secure means of communication.
Nurses practising :
a) Within the framework of the coordinated practice structures mentioned in articles L. 1411-11-1, L. 6323-1 and L. 6323-3 ;
b) As part of a care team in a health establishment, medico-social establishment or army hospital coordinated by a doctor.
