Article L4323-4-1 of the French Public Health Code

The profession of masseur-physiotherapist is practised illegally by :

1° Any person who practises massage physiotherapy, as defined in article L. 4321-1, without holding a state diploma in massage physiotherapy or any other qualification mentioned in article L. 4321-4 required to practise the profession of massage physiotherapist or without being covered by article L. 4321-11 ;

2° Any person holding a diploma, certificate, authorisation to practise or any other qualification as a masseur-physiotherapist who practises physiotherapy without being registered on the register of masseur-physiotherapists in accordance with article L. 4321-10 or during the period of the temporary or permanent ban imposed in application of article L. 4124-6.

The present article does not apply to physiotherapy students or physiotherapy trainees who are doing an internship under article L. 4381-1 or to students who are called up to work in the health reserve or the operational reserve under article L. 4321-7.

Article L4323-4-1

Exerce illégalement la profession de masseur-kinésithérapeute :

1° Toute personne qui pratique la masso-kinésithérapie, au sens de l’article L. 4321-1, sans être titulaire du diplôme d’Etat de masseur-kinésithérapeute ou de tout autre titre mentionné à l’article L. 4321-4 exigé pour l’exercice de la profession de masseur-kinésithérapeute ou sans relever de l’article L. 4321-11 ;

2° Toute personne titulaire d’un diplôme, d’un certificat, d’une autorisation d’exercice ou de tout autre titre de masseur-kinésithérapeute qui exerce la masso-kinésithérapie sans être inscrite à un tableau de l’ordre des masseurs-kinésithérapeutes conformément à l’article L. 4321-10 ou pendant la durée de la peine d’interdiction temporaire ou permanente prononcée en application de l’article L. 4124-6.

Le présent article ne s’applique ni aux étudiants en masso-kinésithérapie ni aux apprentis en masso-kinésithérapie qui effectuent un stage dans le cadre de l’article L. 4381-1 ni aux étudiants qui sont appelés à intervenir dans le cadre de la réserve sanitaire ou de la réserve opérationnelle en application de l’article L. 4321-7.
