Article L441-14 of the French Commercial code

Companies whose annual accounts are certified by a statutory auditor provide information on the payment terms of their suppliers and customers in accordance with procedures defined by decree.

This information is the subject of an attestation by the statutory auditor, under conditions set by the same decree. Where the company concerned is a large company or an intermediate-sized company, within the meaning of the article 51 of Law no. 2008-776 of 4 August 2008 on the modernisation of the economy, the statutory auditor shall send its certificate to the Minister responsible for the economy if it demonstrates, on a repeated basis, significant failings by the company to comply with the requirements of I of article L. 441-10 or 5° of II of Article L. 441-11.

Les sociétés dont les comptes annuels sont certifiés par un commissaire aux comptes communiquent des informations sur les délais de paiement de leurs fournisseurs et de leurs clients suivant des modalités définies par décret.

Ces informations font l’objet d’une attestation du commissaire aux comptes, dans des conditions fixées par ce même décret. Lorsque la société concernée est une grande entreprise ou une entreprise de taille intermédiaire, au sens de l’article 51 de la loi n° 2008-776 du 4 août 2008 de modernisation de l’économie, le commissaire aux comptes adresse son attestation au ministre chargé de l’économie si elle démontre, de façon répétée, des manquements significatifs de la société aux prescriptions du I de l’article L. 441-10 ou du 5° du II de l’article L. 441-11.
