Article L442-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of the provisions of this book to Saint-Barthélemy:
1° Access to work for foreign nationals is exercised under the conditions laid down by the legislation and regulations applicable locally and in compliance with the powers of the collectivity;
2° The civic training mentioned in 1° of article L. 413-3 includes a component relating to the history and geography of the community in which the foreign national resides;
3° In article L. 414-1, the words: “in France” are replaced by the words: “in the territories to which they give access”;
4° In article L. 414-10, the words: “metropolitan territory” are replaced by the words: “territory of the community”;
5° Article L. 414-12 reads as follows:

“Art. L. 414-12.-The issue of residence permits bearing the words “employee”, “temporary worker” and “seasonal worker” respectively, as provided for in Articles L. 421-1, L. 421-3 and L. 421-34, is subject to compliance with the provisions applicable locally in terms of access to work for foreigners and the legislation in force. “6° Article L. 421-8 is supplemented by a paragraph worded as follows:
“The conditions of issue and salary thresholds may differ for the collectivity of Saint-Barthélemy in order to take into account the smaller size of these economies, local demographic dynamics and the situation on the labour market. The Guadeloupe Immigration Observatory provided for in Article L. 158-1 of this Code may be consulted prior to the definition of these conditions and thresholds. “7° In Article L. 421-10, the reference to Article 44 sexies-0 A of the General Tax Code is replaced by the reference to the provisions with the same purpose applicable locally; 8° The first paragraph of Article L. 424-2 reads as follows:
“After submitting their application for a resident’s permit, and while awaiting the issue of this permit, the foreigner mentioned in article L. 424-1 has the right to practise the profession of their choice under the conditions laid down by the provisions applicable to Saint-Barthélemy. “;
9° In the fifth paragraph of article L. 426-4, the reference to article L. 414-14 is deleted;
10° In article L. 431-4, after the words: “authorises its holder to carry out a professional activity”, the words: “under the conditions applicable locally” are inserted.

Article L442-2

Pour l’application des dispositions du présent livre à Saint-Barthélemy :
1° L’accès au travail des étrangers s’exerce dans les conditions prévues par la législation et la réglementation applicables localement et dans le respect des compétences de la collectivité ;
2° La formation civique mentionnée au 1° de l’article L. 413-3 comporte un volet relatif à l’histoire et à la géographie de la collectivité de résidence de l’étranger ;
3° A l’article L. 414-1, les mots : ” en France ” sont remplacés par les mots : ” dans les territoires auxquels ils donnent accès ” ;
4° A l’article L. 414-10, les mots : ” territoire métropolitain ” sont remplacés par les mots : ” territoire de la collectivité ” ;
5° L’article L. 414-12 est ainsi rédigé :

” Art. L. 414-12.-La délivrance des titres de séjour portant respectivement la mention “ salarié ”, “ travailleur temporaire ” et “ travailleur saisonnier ” prévus aux articles L. 421-1, L. 421-3 et L. 421-34 est subordonnée au respect des dispositions applicables localement en matière d’accès au travail des étrangers et de la législation en vigueur. ” ;

6° L’article L. 421-8 est complété par un alinéa ainsi rédigé :
” Les conditions de délivrance et les seuils de rémunération peuvent différer pour la collectivité de Saint-Barthélemy afin de prendre en compte la dimension réduite de ces économies, la dynamique démographique locale et la situation sur le marché du travail. L’observatoire de l’immigration de Guadeloupe prévu à l’article L. 158-1 du présent code peut être consulté avant la définition de ces conditions et de ces seuils. ” ;
7° A l’article L. 421-10, la référence à l’article 44 sexies-0 A du code général des impôts est remplacée par la référence aux dispositions ayant le même objet applicables localement ;
8° Le premier alinéa de l’article L. 424-2 est ainsi rédigé :
” Après avoir déposé sa demande de carte de résident, et dans l’attente de la délivrance de cette carte, l’étranger mentionné à l’article L. 424-1 a le droit d’exercer la profession de son choix dans les conditions prévues par les dispositions applicables à Saint-Barthélemy. ” ;
9° Au cinquième alinéa de l’article L. 426-4, la référence à l’article L. 414-14 est supprimée ;
10° A l’article L. 431-4, après les mots : ” autorise son titulaire à exercer une activité professionnelle “, sont insérés les mots : ” dans les conditions applicables localement “.
