Article L4433-3 of the French General Code of Local Authorities

Each of the Regional Councils of Guadeloupe, Mayotte and Réunion may, on its own initiative or at the request of the Prime Minister or the Minister responsible for the overseas departments, submit to the latter proposals for the amendment or adaptation of legislative or regulatory provisions in force or in the process of being drawn up, as well as any proposals relating to the conditions for the economic, social and cultural development of the region. These proposals may relate to the differentiation, referred to in Article L. 1111-3-1, of the rules relating to the allocation and exercise of powers applicable to these regions, in order to take account of differences in situations.

The proposals adopted by the regional councils in application of the first paragraph of this article are forwarded, by the regional council presidents, to the Prime Minister, to the State representative in the regions concerned and, when they relate to legislative provisions, to the presidents of the National Assembly and the Senate.

The Prime Minister acknowledges receipt of the proposals forwarded to him. An annual report will indicate the action taken on these proposals. This report is made public.

Each of the regional councils mentioned in the same first paragraph may also make to the Prime Minister any comments or suggestions concerning the operation of the State’s public services in the region.

The Prime Minister acknowledges receipt within fifteen days and sets a deadline within which he will provide a substantive response.

Chacun des conseils régionaux de Guadeloupe, de Mayotte et de la Réunion peut, de sa propre initiative ou saisi par le Premier ministre ou par le ministre chargé des départements d’outre-mer, adresser à celui-ci des propositions de modification ou d’adaptation des dispositions législatives ou réglementaires en vigueur ou en cours d’élaboration ainsi que toutes propositions relatives aux conditions du développement économique, social et culturel de la région. Ces propositions peuvent porter sur la différenciation, mentionnée à l’article L. 1111-3-1, des règles relatives à l’attribution et à l’exercice des compétences applicables à ces régions, afin de tenir compte des différences de situations.

Les propositions adoptées par les conseils régionaux en application du premier alinéa du présent article sont transmises, par les présidents de conseil régional, au Premier ministre, au représentant de l’Etat dans les régions concernées et, lorsqu’elles portent sur des dispositions législatives, aux présidents de l’Assemblée nationale et du Sénat.

Le Premier ministre accuse réception des propositions qui lui sont transmises. Un rapport annuel indique les suites qui ont été données à ces propositions. Ce rapport est rendu public.

Chacun des conseils régionaux mentionnés au même premier alinéa peut également faire au Premier ministre toutes remarques ou suggestions concernant le fonctionnement des services publics de l’Etat dans la région.

Le Premier ministre accuse réception dans les quinze jours et fixe le délai dans lequel il apportera une réponse au fond.
