Article L462-2-1 of the French Commercial code

At the request of the Government, the Competition Authority shall give its opinion on the regulated prices and tariffs referred to, respectively, in the second paragraph of article L. 410-2 and in l’article L. 444-1. This opinion is made public.

The Competition Authority may also take the initiative of issuing an opinion on the regulated prices and tariffs mentioned in the first paragraph of this article. This opinion shall be made public no later than one month before the revision of the price or tariff in question.

The initiation of an opinion procedure pursuant to this article shall be made public within five working days, in order to allow consumer defence associations approved at national level to take legal action and the professional organisations or professional bodies concerned to send their observations to the Competition Authority.

A la demande du Gouvernement, l’Autorité de la concurrence donne son avis sur les prix et tarifs réglementés mentionnés, respectivement, au deuxième alinéa de l’article L. 410-2 et à l’article L. 444-1. Cet avis est rendu public.

L’Autorité de la concurrence peut également prendre l’initiative d’émettre un avis sur les prix et tarifs réglementés mentionnés au premier alinéa du présent article. Cet avis est rendu public au plus tard un mois avant la révision du prix ou du tarif en cause.

L’engagement d’une procédure d’avis en application du présent article est rendu publique dans les cinq jours ouvrables, afin de permettre aux associations de défense des consommateurs agréées au niveau national pour ester en justice ainsi qu’aux organisations professionnelles ou aux instances ordinales concernées d’adresser leurs observations à l’Autorité de la concurrence.
