I.-The worker is examined by the occupational physician during a mid-career medical check-up organised at a time determined by industry agreement or, failing that, during the calendar year of the worker’s forty-fifth birthday.
This medical examination may be brought forward and organised in conjunction with another medical examination when the employee must be examined by the occupational physician two years before the deadline set out in the first paragraph of this I. It may be carried out as soon as the worker returns to work, provided that he meets the conditions determined by the industry agreement provided for in the same first paragraph or, failing that, that he is at least forty-five years old.
The purpose of the medical examination is to:
1° Establish an inventory of the suitability of the worker’s job and state of health, to date, taking into account the exposure to occupational risk factors to which he has been subjected;
2° Assess the risks of losing his job, taking into account changes in the worker’s abilities as a function of his career path, age and state of health;
3° Raise the worker’s awareness of the issues involved in ageing at work and the prevention of occupational risks.
The occupational physician may propose, in writing and after discussion with the worker and the employer, the measures provided for inarticle L. 4624-3.
II – The mid-career medical check-up may be carried out by an occupational health nurse in advanced practice. The latter may not propose the measures mentioned in the last paragraph of I. At the end of the visit, the nurse may, if he or she considers it necessary, immediately refer the worker to the occupational physician.
