Article L4643-4 of the French Labour Code

Health and safety committees, set up by collective labour agreements and composed of employer and employee representatives, are responsible for promoting safety training and contributing to the improvement of health and safety conditions.

These provisions do not apply to farms and agricultural businesses that do not have a social and economic committee. These farms and businesses are covered by article L. 717-7 of the French Rural and Maritime Fishing Code, relating to joint health, safety and working conditions committees in agriculture.

If no committees are set up under the conditions provided for in the first paragraph, their task is carried out by professional bodies for health, safety and working conditions set up in the branches of activity presenting particular risks as provided for in article L. 4643-1.

Des commissions de santé et de sécurité, instituées par conventions et accords collectifs de travail et composées de représentants des employeurs et des salariés, sont chargées de promouvoir la formation à la sécurité et de contribuer à l’amélioration des conditions de santé et de sécurité.

Ces dispositions ne sont pas applicables aux exploitations et aux entreprises agricoles qui ne disposent pas de comité social et économique. Ces exploitations et entreprises relevant de l’article L. 717-7 du code rural et de la pêche maritime, relatif aux commissions paritaires d’hygiène, de sécurité et des conditions de travail en agriculture.

A défaut de constitution de commissions dans les conditions prévues au premier alinéa, leur mission est assurée par des organismes professionnels de santé, de sécurité et des conditions de travail constitués dans les branches d’activité présentant des risques particuliers prévus à l’article L. 4643-1.
