Article L4741-1 of the French Labour Code

A fine of 10,000 euros shall be imposed on any employer or his delegate who, through his own fault, disregards the following provisions and those of the decrees of the Conseil d’Etat issued for their application:

1° Titles I, III and IV and Section 2 of Chapter IV of Title V of Book I;

2° Title II of Book II ;

3° Livre III ;

4° Livre IV ;

5° Title I, Chapters II and IV to VI of Title II, Chapter IV of Title III and Title IV of Book V ;

6° Chapter II of Title II of this Book.

A repeat offence is punishable by one year’s imprisonment and a fine of 30,000 euros.

The fine is applied as many times as there are employees of the company concerned, regardless of the number of offences recorded in the official report provided for in article L. 8113-7.

Article L4741-1

Est puni d’une amende de 10 000 euros, le fait pour l’employeur ou son délégataire de méconnaître par sa faute personnelle les dispositions suivantes et celles des décrets en Conseil d’Etat pris pour leur application :

1° Titres Ier, III et IV ainsi que section 2 du chapitre IV du titre V du livre Ier ;

2° Titre II du livre II ;

3° Livre III ;

4° Livre IV ;

5° Titre Ier, chapitres II et IV à VI du titre II, chapitre IV du titre III et titre IV du livre V ;

6° Chapitre II du titre II du présent livre.

La récidive est punie d’un emprisonnement d’un an et d’une amende de 30 000 euros.

L’amende est appliquée autant de fois qu’il y a de travailleurs de l’entreprise concernés indépendamment du nombre d’infractions relevées dans le procès-verbal prévu à l’article L. 8113-7.
