Article L4741-13 of the French Labour Code

Subject to the provisions of the second paragraph, fines imposed in application of article L. 4741-12 may not result in the termination or suspension of the employment contract or in any financial loss to the employees concerned.

When the total and definitive closure results in the dismissal of staff, it shall give rise, in addition to compensation in lieu of notice and compensation for dismissal, to the damages provided for in articles L. 1235-2 to L. 1235-5 in the event of termination of the employment contract.

Les condamnations prononcées en application de l’article L. 4741-12 ne peuvent, sous réserve des dispositions du second alinéa, entraîner ni rupture, ni suspension du contrat de travail, ni aucun préjudice pécuniaire à l’encontre des salariés concernés.

Lorsque la fermeture totale et définitive entraîne le licenciement du personnel, elle donne lieu, en dehors de l’indemnité de préavis et de l’indemnité de licenciement, aux dommages et intérêts prévus aux articles L. 1235-2 à L. 1235-5 en cas de rupture du contrat de travail.
