Article L481-2 of the French Commercial code

An anti-competitive practice referred to in Article L. 481-1 is irrevocably presumed to have been established with regard to the natural or legal person designated in the same Article once its existence and its imputation to that person have been established by a decision which may no longer be subject to an ordinary appeal procedure for the part relating to that establishment, pronounced by the Competition Authority or by the appeal court.

A decision which may no longer be the subject of an ordinary appeal procedure in respect of the part relating to the finding of the existence and imputation of an anti-competitive practice, handed down by a competition authority or by a review court of another Member State of the European Union in respect of a natural or legal person, constitutes evidence of the commission of that practice.

Where a final decision of the Commission, ruling on agreements, decisions or practices covered by Article 101 or 102 of the Treaty on the Functioning of the European Union, has found an anti-competitive practice provided for in those Articles and attributed that practice to a natural or legal person referred to in Article L. 481-1, the national court hearing an action for damages as a result of that practice may not, in accordance with Article 16(1) of Council Regulation (EC) No 1/2003 of 16 December 2002 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty establishing the European Economic Community, now Articles 101 and 102 of the Treaty on the Functioning of the European Union, take a decision that would run counter to the decision adopted by the Commission.

Article L481-2

Une pratique anticoncurrentielle mentionnée à l’article L. 481-1 est présumée établie de manière irréfragable à l’égard de la personne physique ou morale désignée au même article dès lors que son existence et son imputation à cette personne ont été constatées par une décision qui ne peut plus faire l’objet d’une voie de recours ordinaire pour la partie relative à ce constat, prononcée par l’Autorité de la concurrence ou par la juridiction de recours.

Une décision qui ne peut plus faire l’objet d’une voie de recours ordinaire pour la partie relative au constat de l’existence et de l’imputation d’une pratique anticoncurrentielle, prononcée par une autorité de concurrence ou par une juridiction de recours d’un autre Etat membre de l’Union européenne à l’égard d’une personne physique ou morale, constitue un moyen de preuve de la commission de cette pratique.

Lorsqu’une décision définitive de la Commission, statuant sur les accords, décisions ou pratiques relevant de l’article 101 ou 102 du traité sur le fonctionnement de l’Union européenne, a constaté une pratique anticoncurrentielle prévue à ces articles et imputé cette pratique à une personne physique ou morale mentionnée à l’article L. 481-1, la juridiction nationale saisie d’une action en dommages et intérêts du fait de cette pratique ne peut, conformément au paragraphe 1 de l’article 16 du règlement (CE) n° 1/2003 du Conseil du 16 décembre 2002 relatif à la mise en œuvre des règles de concurrence prévues aux articles 81 et 82 du traité instituant la Communauté économique européenne, devenus articles 101 et 102 du traité sur le fonctionnement de l’Union européenne, prendre une décision qui irait à l’encontre de la décision adoptée par la Commission.
