Article L481-3 of the French Commercial code

The loss suffered by the claimant as a result of the anti-competitive practice referred to in Article L. 481-1 includes in particular:

1° The loss made, resulting :

a) The additional cost corresponding to the difference between the price of the good or service that he actually paid and the price that would have been paid in the absence of the commission of the infringement, subject to the total or partial passing on of this additional cost that he may have made to his subsequent direct contractor;

b) The reduction resulting from a lower price paid to him by the perpetrator of the infringement ;

2° The lost profit resulting in particular from the reduction in the volume of sales linked to the partial or total passing on of the additional cost that he was led to make to his direct contractors or from the certain and direct extension of the effects of the price reduction that he had to apply;

3° The loss of opportunity;

4° The non-material loss.

Article L481-3

Le préjudice subi par le demandeur du fait de la pratique anticoncurrentielle mentionnée à l’article L. 481-1 comprend notamment :

1° La perte faite, résultant :

a) Du surcoût correspondant à la différence entre le prix du bien ou du service qu’il a effectivement payé et celui qui l’aurait été en l’absence de commission de l’infraction, sous réserve de la répercussion totale ou partielle de ce surcoût qu’il a éventuellement opérée sur son contractant direct ultérieur ;

b) De la minoration résultant d’un prix plus bas que lui a payé l’auteur de l’infraction ;

2° Le gain manqué résultant notamment de la diminution du volume des ventes liée à la répercussion partielle ou totale du surcoût qu’il a été amené à opérer sur ses contractants directs ou de la prolongation certaine et directe des effets de la minoration des prix qu’il a dû pratiquer ;

3° La perte de chance ;

4° Le préjudice moral.
