Article L490-5 of the French Commercial code

For the offences provided for in Title IV of the present book for which a prison sentence is not incurred and for the contraventions provided for in the present book, the administrative authority responsible for competition and consumption has the right, as long as the public prosecution has not been initiated, to compromise, after agreement by the public prosecutor, in accordance with the procedures laid down by decree in the Conseil d’Etat.

The act by which the Public Prosecutor gives his agreement to the proposed settlement interrupts the statute of limitations for the public prosecution.

The public prosecution is extinguished when the offender has performed the obligations resulting for him from acceptance of the settlement within the time limit set.

Pour les délits prévus au titre IV du présent livre pour lesquels une peine d’emprisonnement n’est pas encourue et pour les contraventions prévues au présent livre, l’autorité administrative chargée de la concurrence et de la consommation a droit, tant que l’action publique n’a pas été mise en mouvement, de transiger, après accord du procureur de la République, selon les modalités fixées par décret en Conseil d’Etat.

L’acte par lequel le procureur de la République donne son accord à la proposition de transaction est interruptif de la prescription de l’action publique.

L’action publique est éteinte lorsque l’auteur de l’infraction a exécuté dans le délai imparti les obligations résultant pour lui de l’acceptation de la transaction.
