Article L511-10 of the French Intellectual Property Code

If a design has been registered in fraud of the rights of a third party or in breach of a legal or contractual obligation, the person who believes he or she has a right to the design may claim ownership in court.

An action to claim ownership shall be barred after five years from the publication of the registration of the design or, in the case of bad faith, at the time of publication of the registration or acquisition of the design, from the expiry of the period of protection.

Si un dessin ou modèle a été déposé en fraude des droits d’un tiers ou en violation d’une obligation légale ou conventionnelle, la personne qui estime avoir un droit sur le dessin ou modèle peut en revendiquer en justice la propriété.

L’action en revendication de propriété se prescrit par cinq ans à compter de la publication de l’enregistrement du dessin ou modèle ou, en cas de mauvaise foi, au moment de la publication de l’enregistrement ou de l’acquisition du dessin ou modèle, à compter de l’expiration de la période de protection.
