Article L5121-29 of the French Public Health Code

Marketing authorisation holders and pharmaceutical companies exploiting medicinal products ensure an appropriate and continuous supply of the national market in order to cover the needs of patients in France.

To this end, any marketing authorisation holder and any pharmaceutical company exploiting a medicinal product shall build up a safety stock intended for the national market and located on French territory, on that of another Member State of the European Union or on that of a State party to the Agreement on the European Economic Area, within a limit set under conditions defined by decree by the Conseil d’Etat and which may not exceed four months’ supply of medicinal product requirements, calculated on the basis of the volume of sales of the speciality over the last twelve rolling months. Information relating to the location of this safety stock is kept at the disposal of the Agence nationale de sécurité du médicament et des produits de santé (French National Agency for the Safety of Medicines and Health Products) and is sent to it at any time at its request.

In addition, marketing authorisation holders and pharmaceutical companies exploiting medicinal products shall provide an appropriate and continuous supply to all establishments authorised as wholesaler-distributors in order to enable them to fulfil the public service obligations mentioned in the first paragraph of Article L. 5124-17-2. They take all appropriate measures to prevent and remedy any supply difficulties and, in the event of a stock shortage, to ensure that the information they have is made available to dispensing pharmacists, pharmacists in the internal-use pharmacy defined in article L. 5126-1 and the pharmacists responsible for or delegated to wholesaler-distributors.

Les titulaires d’autorisation de mise sur le marché et les entreprises pharmaceutiques exploitant des médicaments assurent un approvisionnement approprié et continu du marché national de manière à couvrir les besoins des patients en France.

A cette fin, tout titulaire d’autorisation de mise sur le marché et toute entreprise pharmaceutique exploitant un médicament constitue un stock de sécurité destiné au marché national et situé sur le territoire français, sur celui d’un autre Etat membre de l’Union européenne ou sur celui d’un Etat partie à l’accord sur l’Espace économique européen, dans une limite fixée dans des conditions définies par décret en Conseil d’Etat et qui ne peut excéder quatre mois de couverture des besoins en médicament, calculés sur la base du volume des ventes de la spécialité au cours des douze derniers mois glissants. Les informations relatives à la localisation de ce stock de sécurité sont tenues à la disposition de l’Agence nationale de sécurité du médicament et des produits de santé et lui sont transmises à tout moment à sa demande.

En outre, les titulaires d’autorisation de mise sur le marché et les entreprises pharmaceutiques exploitant des médicaments approvisionnent de manière appropriée et continue tous les établissements autorisés au titre d’une activité de grossiste-répartiteur afin de leur permettre de remplir les obligations de service public mentionnées au premier alinéa de l’article L. 5124-17-2. Ils prennent toute mesure utile pour prévenir et pallier toute difficulté d’approvisionnement et permettent, en cas de rupture de stock, la mise à disposition des informations dont ils disposent aux pharmaciens d’officine, aux pharmaciens de pharmacie à usage intérieur définie à l’article L. 5126-1 et aux pharmaciens responsables ou délégués des grossistes-répartiteurs.
