Medicinal products and products the sale of which is reserved for pharmacists, with the exception of the medicinal products and products mentioned in article L. 5121-8, may not be sold at a price higher than that resulting from the national pharmaceutical tariff. This tariff is set by order of the ministers responsible for the economy and finance, health and social security.
Medicinal products on the list provided for in the first paragraph of article L. 162-17 of the Social Security Code may not be sold to the public at a price higher than the retail price defined in article L. 162-16-4 of the same code. Where applicable, the dispensing fees mentioned in this article are added to the retail price of the medicinal products.
The first two paragraphs do not apply to medicines and products not consumed in France.
Private for-profit health establishments with an in-house pharmacy are required to apply a discount to the price limit provided for in this article for medicinal products not included in the daily prices.
The minimum rate of this discount is set by order of the ministers responsible for the economy and finance, health and social security.
